Instrument of governance

All governing bodies of maintained schools are required to be constituted under the School Governance (Constitution) (England) Regulations 2012 or the School  Governance (Federations) (England) Regulations 2012, as appropriate, by 1 September 2015.

Click here for the  May 2014 guide to the constitution of governing bodies. This guidance is about the constitution of governing bodies and their size, membership  and skills. It also explains the arrangements for the constitution of governing bodies of maintained schools constituted under the School Governance (Constitution) (England)Regulations 2012.

When you have completed a skills audit and revised your instrument against the new regulations the LA (Derby and Derbyshire) will issue an updated instrument of governance including some wording that is required by the Diocese. The LA then seek our approval so that both the LA and Diocese have approved the final version of the document.

I have spoken to Steve Foyster from Derbyshire LA and Jayne Hadfield at Derby LA and they have suggested that schools simply send them revised numbers for the different types of governor with any other changes to the existing IOG. They will then draft the new IOG on behalf of the school.  I think this is a good offer and should help reduce the number of draft versions required before approval.

Instruments of governance are no longer legal entities in our academies and are replaced by articles of association and schemes of delegation.
